2. Description of Services
HomeAppliance.us is a free connection service that helps homeowners find local appliance repair professionals.
IMPORTANT: HomeAppliance.us does not itself provide any appliance repair services. We facilitate connections between homeowners and independent, third-party Service Providers. All repair services are provided by independent contractors who are not employees, agents, or representatives of HomeAppliance.us.
HomeAppliance.us is financially compensated by third-party partners for providing this connection service.
3. Non-Endorsement of Service Providers
HomeAppliance.us does not sponsor, recommend, or endorse any Service Providers that are accessible through the Directory Service. We do not make any representations regarding the competency, trustworthiness, honesty, integrity, qualifications, or behavior of any Service Providers.
The Site facilitates communication between Service Providers and potential customers. Some Service Providers may pay a fee to be included in our network. However, their inclusion does not constitute an endorsement, and HomeAppliance.us makes no warranty regarding the quality, safety, or legality of services provided by any Service Provider.
You, not HomeAppliance.us, are solely responsible for assessing the competency, trustworthiness, honesty, and integrity of all Service Providers that you contact via the Directory Service.
4. Your Responsibilities
It is your responsibility to verify that any contractor you hire has the necessary licenses and insurance required for the work being performed. HomeAppliance.us does not verify licenses, insurance, or credentials of Service Providers.
You should:
- Check the Service Provider's standing with applicable state licensing boards
- Verify insurance coverage
- Request and check references
- Obtain multiple quotes when appropriate
- Review any contract carefully before signing
- Make independent investigations and verify all claims
5. Directory Service
To receive information regarding Service Providers, you must complete the request form on the Site. The information you provide may be shared with Service Providers to facilitate your connection request.
Submitting a request does not create any contractual relationship between you and HomeAppliance.us or any Service Provider. Any agreements for services are solely between you and the Service Provider.
HomeAppliance.us shall not be liable for any modification, suspension, or discontinuation of services by any Service Provider.
6. Requirements
The Site is available only to individuals who are at least eighteen (18) years of age (or the applicable age of majority in their jurisdiction) and can enter into legally binding contracts under applicable law. If you do not meet these requirements, you do not have permission to use the Site.
7. Acceptable Use
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Site in any way that violates any applicable law or regulation
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Engage in any conduct that restricts or inhibits anyone's use of the Site

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM HOMEAPPLIANCE.US OR THROUGH THE SITE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HOMEAPPLIANCE.US SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES.
This includes, but is not limited to, damages for: (a) loss of profits, goodwill, use, or data; (b) costs of procurement of substitute services; (c) failure to connect with Service Providers; (d) quality of work performed by Service Providers; (e) disputes with Service Providers; (f) property damage; (g) personal injury; or (h) any other matter relating to the Site or Services.
IN ANY CASE, HOMEAPPLIANCE.US'S MAXIMUM LIABILITY SHALL NOT EXCEED FIVE HUNDRED DOLLARS ($500.00).
You hereby release HomeAppliance.us from any and all obligations, liabilities, and claims in excess of these limitations.
13. Indemnification
You agree to indemnify, defend, and hold harmless HomeAppliance.us, its parents, subsidiaries, affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, expenses (including reasonable attorneys' fees), and liabilities arising out of or related to:
- Your use of the Site or Services
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Any dispute between you and any Service Provider
- Any services performed by Service Providers
14. Dispute Resolution and Arbitration
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
Mandatory Arbitration
YOU AGREE TO ARBITRATE ALL DISPUTES WITH HOMEAPPLIANCE.US.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved by binding arbitration before the American Arbitration Association ("AAA") in Texas or the county of your residence, in accordance with the AAA's Commercial Arbitration Rules.
For claims of Ten Thousand Dollars ($10,000.00) or less, you can choose whether the arbitration proceeds in person, by telephone, or based only on submissions.
Any award rendered shall be final and conclusive, and judgment may be entered in any court of competent jurisdiction.
Class Action Waiver
YOU AGREE THAT YOU WILL NOT BRING, JOIN, OR PARTICIPATE IN ANY CLASS ACTION LAWSUIT.
To the extent permitted by law, you agree that you will not bring, join, or participate in any class action lawsuit as to any claim, dispute, or controversy with HomeAppliance.us. You agree to pursue claims individually and not as a class action.
Opt-Out Right
You may opt out of the arbitration and class action waiver provisions by providing written notice of your decision within thirty (30) days of first accessing the Site.
15. Modifications to Terms
We reserve the right to modify these Terms at any time in our sole discretion. The latest version will be posted on the Site with the "Last Updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the modified Terms.
However, any amendment to the arbitration provisions or class action waiver shall not apply to disputes incurred prior to such amendment.
16. Termination
We reserve the right to terminate or suspend your access to the Site at any time, for any reason, without notice. Upon termination, all licenses and rights granted to you under these Terms will immediately cease.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and HomeAppliance.us regarding your use of the Site and Services, and supersede all prior agreements and understandings.
19. No Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or of our right to enforce it in the future.
